Will of THOMAS McCUISTON, deceased.
In the name of God, Amen. I, Thomas McCuiston of the county of Calloway and state of Kentucky, calling to mind the certainty of death, and being weak of body, but of sound mind and disposing memory, do constitute this my last will and testament.
Item 1st, I give unto my son Thomas H. McCuiston, the tract of land that I now reside on, with all its appertenances. Also eighty acres of land lying and joining the north west corner of the above named tract.
Item 2nd, I do also give and bequeath unto my six children, to wit, James, Luther and William A. McCuiston, my sons; Cynthia, Levina and Jane, my daughters, the proceeds of a tract of land containing 462 acres, lying in Graves County, state of Kentucky, on the waters of Tarapin Creek. It is also my will and desire that this land be
sold and an equal division of the proceeds thereof to be divided with my, above named six children, on condition if there should be any notes found among my papers or accounts on or against any of the above named six heirs, that they, the principles, be taken in consideration in and with the proceeds of said land in the division.
Item 3, I do also give and bequeath to Elizabeth Eldridge the sum of five dollars. I leave my daughter Sarah, the sum of ten dollars. My family Bible I give unto my son Thomas H. McCuiston. I give my medical book to my son J. C. McCuiston. All my other books I distribute to those whom I may designate their names therein. <<<<< I give unto my daughter Jane Moody, my best bed stead and furniture.>>>> I wish the remainder of my property not named in this article, to be applied to the payment of fifteen dollars named herein, and other expenses which may necessarily incur, and that my executors be liberally compensated for their trouble.
In conclusion, I leave my son James McCuiston and my son William A. McCuiston, my executors to this my last will and testament, ratifying and declaring this to be my last will and testament. In witness whereof, I have set my hand and affixed my seal this September 20th A. D. 1851.

Codicil to the Will of THOMAS McCUISTON, deceased.
To my foregoing will, do will to son Thomas H. McCuiston, all Bedsteds, beds and furniture not otherwise disposed of. Likewise all my household and kitchen furniture, together with my wagon and gear, all my farming utensils, such as plows, hoes and such likes. Likewise the fifteen dollars. The foregoing ten dollars to my daughter Sarah, and five dollars to my daughter- in-law Elizabeth Eldridge, for son Thomas H. McCuiston to pay the same. I do also leave in the hands of my son Thomas H. McCuiston means to defray all necessary expenses and desire him to pay the same whenever sold, for to this my last will and testament, ratifying and declaring this to be my last will and testament. Witness I have set my hand and affixed my seal this October 3rd A.D. 1851.
