Thomas Moody and Mary (probably) Witty

Note

Although the Saunders websitegives a notice that it is insecure, visiting it is probably safe since it requires no financial information and no confidential information, passwords for example.

Mary (Witty?)

Other spouse: Robert Scott (not certain)
view a bit about Robert Scott..

Early genealogists believed the maiden name could have been McCuiston. Name may not have been either McCuiston or Witty, but Frederic "Rick" Saunders has provided extremely good circumstantial evidence for Witty.

A death date of 1794 is reasonable for her since August 1794 is the date the two younger children Thomas L. and Elizabeth either chose a guardian (Thomas to James McCuiston) or had a guardian appointed (Elizabeth, about 14, to Ann Moody McCuiston, her half-sister). The will of their step-father, Robert Scott, had been probated in 1791.

Children of Thomas Moody and Mary (Witty?)

  1. Mary Moody
  2. Nancy Anne
  3. Thomas L. Moody
  4. Elizabeth

Nancy Anne Moody, who married Thomas McMichael may be the daughter of Thomas's and first wife Jean's son Alexander and his wife of unknown name although there are arguments against their being such. Being 18 or older in 1794 (born by 1775 or 1776) when Mary Witty, then Scott, likely died could mean that no guardian was required for Nancy if she was Thomas's and Mary's daughter. She would have been no more than 5 when the 1781 court appointed a guardian for Alexander's son Nathaniel upon his father's death.

A birth date of 28 January 1776 and death date of 5 April 1838 are supposedly engraved on Nancy Anne's gravestone, but I cannot read the dates on the photo I viewed on Find a Grave.

Guardianship for children

Guilford County Quarterly Sessions Court, August 1794

18 August, page 267: Ordered that an orphant Garl Named Elizabeth Moodey aged 13 years old be bound to Ann McCuiston Widow untill she arrives to ful age

22 August, page 273: Thomas Moody Orphant of Thos. Moody Decesd. being of proper age Came into Court and made choice of James McCuiston for his Guardien

Guardians were not appointed during this session of court for Nancy Anne or Mary. If they were daughters of Thomas and Mary, this implies they had reached legal age, which was likely 16 for females since a female could marry without a parent or guardian's approval at that age.
